On January 17, 2024, the Alaska Supreme Court signed SCO No. 2016 amending Bar Rules 65 and 66 to increase mandatory continuing legal education for active bar members to twelve CLE credit hours per year. Three of those twelve CLE credits must be ethics CLE. The rule will go into effect on January 1, 2025, and the first reporting deadline for the new rule will be February 1, 2026. * At least 1 hour of Technology in the Practice of Law: One hour addressing technology in the practice of law, including education on technology tools, programs, or applications to assist attorneys in their law practice

* At least 1 hour of Civility in the Legal Profession: One hour addressing civility in the legal profession, including education that discusses the link between civility and bias, incivility that is directed at opposing parties or counsel, and incivility aimed at the judiciary

* At least 2 hours of Competence Issues: At least one of the two hours must be focused on prevention and detection education that addresses substance use or other mental or physical issues that impair a licensee’s ability to perform legal services with competence (prevention and detection competence); and An optional one-hour focused on wellness education, including physical and mental wellness and wellbeing or stress management, in the context of the practice of law and the impact these issues can have on an attorney’s ability to perform legal services with competence (wellness competence)

NOTICE: Please note the following updates to MCLE compliance deadlines:

* Last names A-G: Extended to a single 38-month cycle ending March 29, 2025. Report deadline: April 1, 2025.

* Compliance groups 2 and 3: Extended to a single 38-month cycle ending March 29, 2026, or 2027. Report deadline: March 30.

* After the single 38-month cycle, each group returns to a standard 36-month cycle starting March 30 of their respective year and ending the day before the deadline 36 months later.

Attorneys assigned to a compliance group will always remain in that same group, even if they change their last name.
* Attorneys admitted on or before Feb. 1, 1992, were assigned to a compliance group based on the first letter of their last name, as listed on their official State Bar records, effective Feb. 1, 1992 (the beginning of the MCLE program.)
* Attorneys admitted after Feb. 1, 1992, are assigned to a compliance group based on the first letter of the last name listed on their admit cards. Admit cards are filled out when they are sworn in.

All actively licensed attorneys who are required to comply with Colorado’s CLE requirements—in all compliance periods—must comply with this requirement.

There is no requirement that you send in any written proof of compliance to the Judicial Branch, bar association, or Statewide Grievance Committee. The MCLE program in Connecticut is a self-reporting system. You keep track of the courses and hours that you take each year, maintain records to prove compliance with the rule for seven years (see Practice Book §2-27A(d)), and certify on your annual registration form that you have complied with the rule or are exempted from compliance.

Newly Admitted Requirement:

Newly admitted attorneys have to comply with the Rule in the
calendar year following their admission or certification.

For example, lawyers admitted in 2017 do not have to take courses

Attorneys who are not compliant by December 31 of their compliance year will be assessed a $150 penalty; noncompliant attorneys who do not cure their noncompliance by March 1 will be assessed an additional $150 penalty; and those who do not cure by April 1 will be assessed an additional $200 penalty. Attorneys who do not cure their noncompliance by April 15 will be administratively suspended.

TRTCLE will report your completed credits to the Supreme Court of Delaware.

Newly Admitted Requirement:

When attorneys are admitted to the Supreme Court of Delaware, the Clerk of the Supreme Court notifies the Commission of the attorney's name, address, identification number, and date of admission.

Attorneys admitted in the December admission ceremony have a 24-credit requirement due by December 31 of the year which is two years following admission.

The CLE requirement for a newly admitted attorney begins on January 1st of the year after which he/she is admitted to the Delaware bar. As to any attorney admitted after December 1, 2015, within four years of the start of the attorney’s CLE requirement (i.e., two compliance periods) the attorney MUST attend the following seven Fundamentals programs, available only through the Delaware State Bar Association: (1) Fundamentals of Lawyer-Client Relations; (2) Fundamentals of Family Law; (3) Fundamentals of Real Estate; (4) Fundamentals of Civil Litigation; (5) Fundamentals of Will Drafting and Estate Administration; (6) Fundamentals of Law Practice Management and Technology; and (7) Fundamentals of Criminal Law and Procedure.

Attendance at these programs shall be credited towards the attorney’s minimum continuing legal education requirements for the compliance period. The Fundamentals requirement is in addition to the required attendance at the Court’s Pre-Admission Conference prior to being admitted to the Delaware Bar.

**IMPORTANT UPDATE**

Effective January 8th, 2024, the Supreme Court of Florida amended Bar Rule 6-10.3(b) (Minimum Hourly Continuing Legal Education Requirements):

1. The overall CLE requirement is reduced from 33 to 30 hours per reporting cycle.

2. Bar members are required to complete a two-hour legal professionalism course produced by The Florida Bar and approved by the Court during each reporting cycle. This two-hour course, which the Bar will offer free of charge, replaces the existing one-hour professionalism program requirement.

3. Bias Elimination is removed from the requirement that “at least 5 of the 30 credit hours must be in approved legal ethics, professionalism, substance abuse, or mental health and wellness programs.” Courses in “bias elimination” that meet The Florida Bar’s general course approval requirements will continue to count toward fulfilling Bar members’ overall 30-hour CLE requirement, but such courses will no longer count toward fulfillment of the five-hour sub-requirement specified in the rule.

Newly Admitted Requirement:

All Florida Bar members in good standing under the age of 36 and all members in good standing who have not been admitted to the practice of law in any jurisdiction for more than 5 years is a member of the Young Lawyers Division (Rule 1.9.1 of the Rules Regulating The Florida Bar).

There two phases to the BSCR (Rule 6-12.3). They are:

Phase I: Completion of Practicing with Professionalism (PWP) within the first year of admission to The Florida Bar.

Phase II: Completion of 3 basic level programs (or 21 hours of basic level programming) within the first three years of admission to The Florida Bar. Basic level courses that satisfy the BSCR requirement will begin with the term “Basic” in its title (i.e. Basic Criminal Law, Basic Trial Practice, Basic Real Property, etc.), and sponsored by the Young Lawyers Division of The Florida Bar.

Newly Admitted Requirement:

The CLE requirement is waived for the calendar year that a member is admitted to the Bar. However, pursuant to RSCH Rule 1.14, this waiver does not modify the requirement that the attorney must complete the Hawaii Professionalism Course mandated by the Hawaii Supreme Court no later than December 31st of the following year of election of active status.

As an added bonus, upon completion of the Hawaii Professionalism Course attorneys will earn 4.5 CLE credits, 3 of which may be carried over into the next year to be used towards the annual requirement.

As of August 1, 2019, TRTCLE will report all completed courses and credits to the Illinois Minimum Continuing Legal Education Board. To do so, attorneys must have Illinois and his/her ARDC number indicated in his/her TRTCLE profile to be reported.

The Illinois MCLE Board charges a late fee of $5.00 per course for each course not reported within thirty (30) days of the course being completed. If an attorney completes a course(s) but does not have his/her ARDC number indicated in his/her TRTCLE profile, then the credits will not be reported timely, which will result in the Board charging $5.00 per course that needs to be reported.

The second year in the period is the reporting year. To avoid late fees, all CLE hours must be completed by 11:59 PM CDT on June 30 of that year (completion deadline), and your compliance (or a valid exemption that needs to be reported) must be reported by 11:59 PM CDT on July 31. Online reporting opens on May 1 of your reporting year.

Reporting Information:

TRTCLE will report your individual courses and subsequent credits to the Illinois Minimum Continuing Legal Education Board. In order to do so, you must have Illinois and your ARDC number indicated in your TRTCLE profile.

The Illinois MCLE Board charges a late fee of $5.00 per course for each course not reported within thirty (30) days of the course being completed. Annual reports are due by March 10, 2025. If an extension is needed for CLE hours, log into your account on the Iowa Supreme Court Commissions website to request an extension. Yearly CLE filing requires 15 hours of CLE, 1 hour of which must be accredited for legal ethics and 1 hour accredited for either attorney wellness or diversity. Attorneys admitted in calendar year 2024 do not have a CLE obligation but must still file a 2024 CLE report.

Newly Admitted Requirement:

Iowa newly admitted attorneys must complete an 8-hour Basic Skills course within one year from the date of admission to practice in Iowa. The program must have at least 1 hour of ethics and focus on Iowa law in at least 8 of the following 10 practice areas: Civil Procedure; Criminal Law; Criminal Procedure; Family Law; Guardianship, Conservatorships, Trusts, and Powers of Appointment; Business Entities; Probate; Torts; Contracts; Real Estate Transactions; and Ethics and Professionalism.

COMPLIANCE PERIOD RULE:
Compliance Group 1: Attorneys born in January through June report in even-numbered years.

New Jersey attorneys certify compliance on the Annual Attorney Registration and Billing Statement. They must maintain possession of their Certificates of Attendance for at least 3 years as they will be asked to produce those records in the event of an audit.

Reporting Information:

New Jersey is a self-reporting state; therefore, attorneys must maintain all necessary records and documentation to demonstrate compliance in accordance with the Board’s Regulations. Random audits of individual attorneys will be performed to ensure the overall compliance of attorneys. If randomly audited, an attorney will be required to submit all certificates of course attendance obtained during a compliance period as proof of compliance with the CLE requirement.

For reporting compliance, an attorney whose birthday is between January 1 and June 30 is in Compliance Group 1. An attorney whose birthday is between July 1 and December 31 is in Compliance Group 2. Those in Group 1 will report the completion of the required credits taken during the compliance period in the annual attorney registration and billing process in even-numbered years; for example, an attorney born in February would report compliance in 2014, 2016, 2018, etc. Those in Compliance Group 2 will report compliance in odd-numbered years in the annual attorney registration and billing process; for example, an attorney born in July would report compliance in 2015, 2017, 2019, etc. Attorneys are encouraged to register and report CLE compliance online, rather than through the paper billing process.

Newly Admitted Requirement:

Every active lawyer is required to complete 24 credit hours of continuing legal education (CLE) every 2 years. Of those 24 credits, at least 5 credits must be in ethics and/or professionalism, including 2 credits of coursework in diversity, inclusion, and elimination of bias.

During the newly admitted lawyer’s first full two-year compliance period, within the general 24 credit CLE requirement, a newly admitted lawyer with a plenary license in New Jersey must obtain 16 credit hours in at least 6 of the following 12 subject areas: New Jersey basic estate administration; New Jersey basic estate planning; New Jersey civil or criminal trial preparation; New Jersey family law practice; New Jersey real estate closing procedures; New Jersey attorney trust and business accounting fundamentals; New Jersey landlord/tenant practice; New Jersey municipal court practice; New Jersey law office management; New Jersey administrative law; New Jersey workers’ compensation law; and New Jersey labor and employment law. At least one credit of the required sixteen credits must be in New Jersey attorney trust and business accounting fundamentals.

A “newly admitted lawyer” is defined by the Board on Continuing Legal Education (Board) as a lawyer who becomes an active member of the New Jersey bar for the first time. Newly admitted attorneys with a limited license do not have to take the 16-credit new admit coursework. Some newly admitted attorneys, depending on when admitted and when their birth month falls may have a one-year transitional reporting period.

Note: Effective December 1, 2023, an amendment to Part 118 of the Rules of the Chief Administrator will require every attorney admitted to the bar in the State of New York, whether they are resident or non-resident, active or retired, or practicing law in New York or anywhere else to file their biennial registration electronically – see press release. Attorneys may utilize their Online Services account to file their registration electronically, make changes to contact information or view receipts – Sign in to Online Services.

Section 468-a of the NY Judiciary Law and 22 NYCRR Part 118 of the Rules of the Chief Administrator of the Courts require the biennial registration of all attorneys admitted in the State of New York, whether they are resident or non-resident, active or retired, or practicing law in New York or elsewhere. All attorneys are required to renew their attorney registration every two years, within 30 days after their birthday.

The fee for registration is $375.00 (of which $60.00 is deposited in the Lawyers’ Fund for Client Protection, $50.00 in the Indigent Legal Services Fund, $25.00 in the Legal Services Assistance Fund, and the remainder in the Attorney Licensing Fund).

No fee is required from an attorney who certifies that he or she is retired from the practice of law as defined in 22 NYCRR 118.1(g).

Newly admitted attorneys must take 16 total accredited CLE hours of transitional CLE courses, of which 3 Ethics and Professionalism must be in a traditional Live classroom setting, a fully interactive video conference, or a live webcast or teleconference. Beginning November 1, 2019, each active member of the Virginia State Bar shall certify whether they have attended, within the past three (3) years, at least one (1) credit hour of lawyer well-being education related to the practice of law.
