Many attorneys often enter practice with a strong focus on advocacy and winning, yet quickly discover that most legal matters are resolved through negotiation and settlement rather than trial. This course reframes negotiation not as a concession, but as a core professional skill grounded in strategy, thoughtful problem-solving, and sound ethical judgment, including the professional responsibilities that govern settlement practice, rather than adversarial posturing.

Attorneys will examine why settlement matters from client, court, and professional perspectives, and how a restorative approach to negotiation can improve outcomes without compromising advocacy. The course presents restorative negotiation as both a mindset and a practical framework grounded in listening, accountability, dignity, and shared problem-solving. Particular attention is given to client-centered settlement practice, including how attorneys communicate about resolution in ways that avoid making clients feel pressured or defeated. Attendees will learn practical strategies and structured frameworks to engage clients as partners in the process, strengthening trust, informed decision-making, and the likelihood of durable, sustainable resolutions.

This course is designed for attorneys, judges, and other legal professionals seeking a more client-centered, effective, and restorative approach to negotiation and dispute resolution.
