Ineffective assistance of counsel is a serious issue that can threaten the integrity of the entire judicial system, and therefore it must be thoroughly appreciated by attorneys. Many ineffective assistance of counsel claims involve the disclosure of confidential information and a breach of the client-attorney relationship, both of which are central to ABA Model Rule 1.6. This seminar focuses on how instances of ineffective assistance of counsel can arise, including common ineffective assistance issues, and the implications of ABA Model Rule 1.6. Four cases — Manier v. United States, In re Conry, United States ex rel. Holmes v. Northrop Grumman Corp., and Mont. Merch., Inc. v. Dave’s Killer Bread, Inc. — help to exemplify these concepts.
