Attorneys seeking to expand their practice into the new creator economy should become familiar with one of its central pillars: the Right of Publicity.  To understand its importance, we will compare historical and current events.  Attendees will come away with the view that the Right of Publicity, as a body of law, is expanding and warrants more attention.

Attendees will learn that the Right of Publicity is a quasi-intellectual property right subject to contractual licensing.  They will learn its limitations as a state law against other Intellectual Property frameworks.  This program will also review business necessities and nuances within the creator economy regarding the use and need for protection of the right of publicity.

This course is designed for legal professionals interested in creator and brand partnerships and who want to ensure that creators are protected in those deals. Attorneys at all practice levels will gain valuable knowledge and skills from this course.

Learning Objectives:

  • Review the Right of Publicity from the late 19th Century to today. 
  • Evaluate the interplay between state right of publicity and federal IP laws. (Pre-emption). 
  • Explain foundational creator economy concepts, including creator–brand relationships, brand safety considerations, morality clauses, and related contractual expectations.
  • Analyze terminology and licensing frameworks used in creator agreements.
  • Identify key contract-drafting considerations and talent-management strategies when structuring creator partnerships.
