North Carolina Criminal Procedure Update
About This Course
This course is designed for North Carolina attorneys involved in litigation or policy responsibilities related to criminal law and procedure. Attorneys with an interest in the topic but who are not litigators or advisors are also welcome to attend.
The program will have both a substantive and skills-based approach. As to the former, recent United States Supreme Court, Fourth Circuit, and state cases will be discussed. Recent statutory changes related to criminal law and procedure will be reviewed. The skills component will involve identifying common suppression hearing issues and the best strategies to increase the chances of winning such hearings.
This program is suitable for attorneys with any amount of experience who are interested in recent changes in North Carolina state criminal procedures and statutes. Attendees will be expected to review suppression hearing-related fact patterns in advance of attending this webinar.
Learning Objectives:
- Examine recent case law from both the United States Supreme Court and the states.
- Evaluate the scope of and limits of law enforcement in different situations (street encounters, traffic stops, hot pursuit).
- Review recent criminal law and procedure-related statutory changes.
- Identify common suppression hearing issues.
- Apply legal standards to fact patterns to determine the admissibility of evidence and potential violations.
