Tribunals depend on candor from officers of the court. The avoidance of misrepresentation – whether by omission or outright deceit – is the crux of Model Rule 3.3. Focusing on outcomes where attorneys were less than forthcoming with judges, such as the special importance of candor at ex parte hearings, is but one example of a problem addressed in the materials for today’s materials. Special attention is devoted to circumstances where a lawyer’s failure to reveal information may be equated with misrepresentation.
