Subpoenas for Tech Startups: Essential for Lawyers

This Course
As more states are enacting data privacy and cybersecurity protection laws, businesses of all sizes and types are likely to face subpoenas and other requests for information from state enforcement authorities. Attorneys should attend this program to learn how to respond to civil investigative demands. This course teaches attorneys how state investigative matters differ from regular civil discovery requests. They will also learn best practices for responding to such subpoenas, including protecting confidential and proprietary business data.
Attorneys of all levels are encouraged to attend this program to learn how to advise businesses as they navigate subpoenas. This program will especially benefit in-house counsel with protected employee and consumer data from startups and tech companies.
Learning Objectives:
- Explore investigative tools available to state authorities, including demands for documents, written responses to interrogatories, and testimony under oath
- Explain best practices for responding to a subpoena or demand, including document preservation, communicating with government counsel, and negotiating protective orders to protect proprietary business information
- Describe insights about demands that can be handled in-house versus those that outside counsel is better positioned to handle
