It is crucial for lawyers to maintain a clear understanding of the distinctions between various types of experts and what discovery rules apply to different experts in order to adequately prepare for trial. This course will cover definitions of different types of experts and witnesses, describe the various roles experts may assume, and advise lawyers about potential challenges that may arise in cases that rely heavily on expert opinion. It will lay out which types of experts are protected under work-product privilege and examine the various criteria that factor into the discoverability of expert work-product. Class participants will be informed as to how they may best protect work product from discovery and then presented with a series of hypothetical cases and follow-up questions involving the course material.
