Lawyers are subject to professional discipline when they violate the Model Rules of Professional Conduct, knowingly assist or induce another to do so, or do so through the acts of another, as when they request or instruct an agent to do so on the lawyer's behalf.

In this informative course on lawyer misconduct, Mr. O'Donnell will begin by explaining the provisions and activities that can constitute misconduct, including specific violations, criminal acts, dishonesty, conduct prejudicial to justice, improper influence, and other types of misconduct. A real-life case study about an attorney who helped a client flee, ending up exposing a murder investigation, is discussed. Additional Model Rules, including 3.4: Fairness to Opposing Party and Counsel, Model Rule 5.1: Responsibilities of Partners, Managers, and Supervisory Lawyers are discussed. Lastly, Mr. O'Donnell will review Model Rule 1.6: Confidentiality of Information.
