We live in a world of television where we receive much of our information from sound bites and video clips. Today it’s all about the “optics.” So whether you’re using demonstrative evidence, conducting video depositions, or participating in meetings and conferences by way of videoconference calls (e.g., Zoom, Skype Facetime), the major principles and techniques for making visual evidence are the same. Jurors actually expect to be informed and persuaded with audio-visual evidence. And since advocacy is a contest in persuasion, using video for evidentiary proof can be a very powerful tool. New rules of evidence facilitate the use of modern technology to present complex fact patterns using concise and interesting images and videos that engage and educate the judge and jury, usually better than spoken and written words. And due to the requisite social distancing of the COVID19 pandemic, most attorneys will need to communicate more frequently in their practices by way of videoconferencing and use more images and video clips than ever before. Their remote meetings with clients, staff, counsel, judges, and jurors will require communication skills using many of the same principles, techniques, and strategies as those for making effective visual evidence for litigation. 

This course teaches the rules, laws, and best techniques, pitfalls, and practices for creating convincing and admissible audio-visual proof while identifying and resolving attendant evidentiary issues.
