This CLE course is focused on the discoverability of work product produced by third-party individuals hired by lawyers to contribute field-specific information to the materials of a case. The course will refer to provisions of the Federal Rules of Civil Procedure and the Federal Rules of Evidence and will cover the specific roles of various types of experts and witnesses. The instructor will discuss the discovery limits of these third-party individuals and how it depends on if these witnesses will testify in trial or not. Class participants will be presented with hypothetical scenarios in the area of discovery and expert witnesses.
