“Can a prosecutor steal defense counsel’s legal notes with impunity?” The first impression would suggest the answer would be a resounded “No”. But what if further pondering the query the answer were to be found ambiguous? Or “What case can be made for absolute immunity of prosecutors?” Does absolutism cause us to hedge our answers when determining whether prosecutorial ethics remains in the crosshairs? What district attorneys, federal or special prosecutors, might seem poster-child candidates for the crosshairs in public or professional opinion? Just asking, but such questions are good to consider and even ponder.
