Social media presents a host of challenges for attorneys, including discovery, evidentiary and ethical questions. The myriad issues relating to the ever-evolving world of social media and where it intersects with legal practice and especially litigation, include the following familiar questions and themes: (1) How to obtain discovery evidence from or related to social media networking sites, and the corollary, how does one resist such efforts? (2) How to introduce the resulting evidence at hearing or trial or how to block its admission? (3) What ethical rules considerations arise that are associated with social media? and (4) How to avoid any ethical missteps?
