About This Course
In this seminar, Professor Michael Resko presents major issues and questions that arise during arbitration. The course aims to discuss how arbitration differs from litigation and other forms of dispute resolution techniques and the essentials of a well-drafted arbitration clause. Furthermore, Mr. Resko examines pre-hearing issues involving the choice of the arbitrator, communicating with the arbitrator, the application of the rules of evidence and pre-hearing discovery. Finally, the course explores the concept of whether the arbitrator should participate in settlement discussions or serve as a mediator.
