“Fees” rate near the top concerns for lawyers and clients alike.  Comparing ABA Model Rule 1.5 (Fees) to CA Rule 4-200 (Fees for Legal Services) affords an opportunity to reexamine the ABA concept of reasonable and unreasonable language to conscionable and unconscionable terminology.  In this course, Mr. O'Donnell discusses the importance of the legal ethics issue regarding nonrefundable fees. Furthermore, Mr. O'Donnell explores other interesting ethical issues that focus on quid pro quo regarding fees, when a fees grievance is dropped, as well as the reasonableness of the concept of nonrefundable engagement fees.
