Description - Analysis/discussion of a series of ethical "mysteries" (including client-counseling skills and issues) and the historical evolution of the regulation of the practice of law in the context of ethical rules, civil malpractice standards and legal proscriptions and prescriptions. This seminar provides a historical summary of the evolution of ethical, civil and criminal standards affecting the practice of law and the enforcement of such standards as part of the background for problem-solving exercises involving a series of hypothetical scenarios raising ethical/professional problems. The author describes a number of common-sense methodologies for analyzing and solving such problems. The author's background is that of a former disciplinary prosecutor and subsequent defense-counsel/advisor to lawyers and judges on professional responsibility issues.
